By subscribing to, accessing, or using the WorkTrac application ("the Service"), you ("the Client") agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Service.
WorkTrac grants you a non-exclusive, non-transferable, revocable license to use the Service for your internal business operations. You agree not to reverse engineer, copy, or resell the Service.
3.1. Estimates Only: The Service includes features to calculate Gross Pay, including Overtime, Shift Loading, Penalties, and Superannuation. You acknowledge that these calculations are estimates only and depend entirely on the data configurations input by you.
3.2. No Tax Calculations: The Service currently generates Gross Pay only. It DOES NOT calculate PAYG Withholding, income tax, or other statutory deductions. You are solely responsible for calculating and withholding the correct tax amounts in compliance with the Australian Taxation Office (ATO).
3.3. Compliance Responsibility: It is the Client's sole responsibility to ensure that all pay rates, penalty rates, and award interpretations in the Service comply with the relevant Fair Work Awards (e.g., Cleaning Services Award) or Enterprise Agreements. WorkTrac accepts no liability for underpayment or overpayment of staff resulting from reliance on the Service's calculations.
You may use the Service for 14 days free of charge. No credit card is required to start. To continue using the service after the trial, valid payment details must be provided. If payment is not added by the end of the trial, access will be suspended.
5.1. Billing: Subscription fees are billed in advance (Monthly or Yearly). Fees are non-refundable, including for partial months of service.
5.2. GST: All fees are exclusive of GST unless otherwise stated on the invoice.
6.1. Data Ownership: You retain all rights to the data you input into the Service ("Client Data").
6.2. Security: WorkTrac uses industry-standard security measures (SSL, secure servers) to protect your data. However, no internet transmission is 100% secure.
6.3. Backups: While WorkTrac performs regular system backups, you are responsible for exporting your own critical data (e.g., timesheets/payslips) for your records.
To the maximum extent permitted by Australian law (including the Australian Consumer Law):
You may cancel your subscription at any time. Upon cancellation, your access will continue until the end of the current billing cycle. WorkTrac reserves the right to terminate accounts that violate these terms or use the Service for illegal activities.
These Terms are governed by the laws of the Northern Territory, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts in Darwin, NT.
